On Thursday June 28th, five days before Tom Cruise’s 50th birthday, Katie Holmes filed divorce papers in New York. Although the couple have faced breakup rumors ever since their whirlwind romance led to an engagement, baby and then marriage, the timing and circumstances of the breakup still came as a surprise to most.
The unexpected announcement has also raised the question of whether Cruise was taken by surprise by the move. He has confirmed that it was Holmes who filed for divorce and not him – and the brief statement from his rep spoke of the star needing privacy to “work this out.”
Katie is seeking primary custody of their six-year-old daughter Suri, according to TMZ. She has cited “irreconcilable differences” as the cause of the split and is asking for “primary residential custody” of Suri.

Marriage Breakdown – What Caused The Breakup?
In the days after last week’s headline-grabbing announcement that Katie Holmes is seeking a divorce from couch maniac and Scientologist-in-Chief Tom Cruise, “sources connected to the couple” have revealed Holmes’ reasoning.
It appears that their differing ideas on how to parent their daughter Suri may have been a catalyst for their pending divorce. Sources say that Cruise’s ties to the Church of Scientology and his subsequent approach to raising Suri were difficult for Holmes to handle.
A friend of the actress told Radar Online…
“Katie wants Suri to go to school with other children and have a grounded routine whereas Tom doesn’t. Tom is nowhere near as strict as Katie is and doesn’t believe in disciplining Suri, whereas Katie believes that’s important. Tom basically treats Suri as a little adult, and that causes some major clashes over parenting style.”
Filing For Divorce In New York – A Strategic Move?
According to New York law, a judge has the discretion to consider causes for a marriage coming to an end, including disagreements over how to raise a child.
A source close to the situation has told Radar Online that Holmes filed for the divorce and for sole custody of Suri in the Big Apple for that specific reason alone, saying…
“Allegations of cheating or verbal/physical abuse are taken very seriously in New York and can be determining factors in custody and support issues.”
The Prenup – What’s in It?
Cruise was recently ranked in the No. 9 spot on Forbes’ Celebrity 100, with the magazine placing his earnings at $75 million. According to IMDb, Holmes is worth an estimated $25 million.
MSNBC has reported that the couple have a prenup which entitles Holmes to $3 million for each year that she was married to Cruise ($15 million total). She will also receive a “palatial” home in California when the divorce is made official (the couple also owns property in NYC, Beverly Hills, Sussex and Lake Cuomo).
Since they were married for less than 11 years, the prenup states explicitly that California’s community property laws will not be applied to the divorce, meaning Holmes is not entitled to 50 percent of Cruise’s reported $250 million fortune.
The couple shares one child, 6-year-old daughter Suri. Details of a forthcoming custody agreement are not yet known, thoughTMZ reports that Holmes is seeking sole custody and a suitable amount of child support.

Katie Holmes was photographed looking happy and laughing (left) in NYC on Tuesday, when she dropped by an ice cream parlor with her daughter Suri.
TMZ report that Katie and Suri weren’t alone at the time. They were photographed at an East Village ice cream shop with some friends and four bodyguards.
While shopping for groceries on Tuesday also, Holmes spoke out for the first time since filing for divorce from Tom Cruise telling a New York Daily News reporter “I’m alright, Thank you.”

When Katie Holmes spoke to Elle for the magazine’s August issue, she was about six weeks away from filing for divorce from Tom Cruise, however it now appears that she may have hinted at her plans to file.
